How to transfer car in the event its owner is deceased

In case the car's owner passes on, how do we proceed with the transfer of ownership of the car? What documents and procedures are required?

In case the car's owner passes on, the car ownership can be transferred to yourself or others, but additional documents may be required. There also must be a trustee to carry out various procedures on behalf of the deceased. If there is no trustee – even if you are a legitimate child – you cannot transfer ownership of the car.

We can initiate the transfer for this case in two ways:

1. Appeal to the court to be the administrator of the estate, and bring a court order to carry out the transfer of the car

Documents and evidence required at this stage

  • Car registration handbook
  • Copy or photo of the owner's death certificate
  • Copy of the court order appointing the administrator of the estate
  • Evidence of the identity of the administrator of the estate as the transferer and the transferee, such as a photo of an ID card, a photocopy of house registration, and a certificate of registration of a juristic person (in the case of a juristic person)

Action steps

  • Fill out the transfer request form and sign the documents
  • Submit a request for transfer of ownership of the car with evidence
  • Send the car for a car inspection
  • Pay a fee
  • Get the document back

2. Notify the transport office to send a letter to the district where the deceased is domiciled to check the heirs

Documents and evidence at this stage

  • Car registration handbook
  • Copy or photo of the owner's death certificate
  • Evidence of the identity of the administrator of the estate as the transferer and the transferee (e.g. ID card photos, photocopy of house registration, and certificate of registration of a juristic person [in the case of a juristic person])

After verifying the validity of the car, a letter for the heirs who requested to transfer will be sent to the district office where the deceased is domiciled, and they will be asked.

If no one objects to the car ownership transfer within 30 days, the district office will issue a certificate and bring it to the transport officer for the transfer process to continue.

Where to notify the transfer of ownership of the car?

If the transferor or transferee is unable to proceed by himself/herself, then a power of attorney should be the operator instead. The operator representing on the transferrer/transferee's behalf must also present his ID card.
